It said my stuff was up to date. I am under a 2 year warranty i believe, which isn't even close to being out yet. do i just call dell and say whats up?

Does the fault occur when you put the system into hibernation, press shift key and the stand by button should change to say hibernate. Try this and see if it does it on awakening. If its still the same I would return the unit.
