I would think these VPS are sandboxed to prevent just that wouldn't you think Lebowski?

Sandboxed yes, probably chrooted or less likely virtualised.

There's always a possibility, I mean, Kevin Mitnicks site got vandalised a while back, who predicted that?

Though I do doubt that he could be held responsible for it though, just a precaution because of the way he mentioned the ToS

A vulnerability in the software bringing down the server would really only happen during a DDoS attack, and they usually catch that at the network level and blackhole your IP until they can get it resolved.
