All iPod games I know of have to be bought, so to do it legally.. nope. Unless you make your own

iPod Arcade | Free iPod Games | Games for your iPod

Only problem is they're rubbish quiz type things.
I've tried a few out, wasn't impressed.

I have seen some websites that claim to have legal downloads for free but they are not .legal.

This is a longshot but.... how about contacting apple for a distributer license?
