Well first of all, the key word you pointed out here is "overwritten". Once a file has been overwritten with a new file, it is not possible to retrieve the old file, because it has been "overwritten", as in the old data is no longer there! If the iPod was formatted, then the pointer to that file may still exist in it's Allocation Table. This does not mean that the data can be retrieved, only the pointer to it. So it really depends on how much of the data has been overwritten, and how much the iPod has been used since, will define how much you can actually recover.
As for recovery software, it really depends on how much you value the music that is left. When it comes to recovery software, you really do get what you pay for. I have yet to come across a free tool that does the job, or even comes close. One of the best tools I've come across is called R-Studio, which may work with your iPod, but again comes with a similar price tag. At least with this software, you can scan your iPod, and find out how much is actually retrievable before you pay for the software. Full recoveries are marked in green, partial recoveries will be marked orange, and files that cannot be recovered are marked in red.
